ADOPTED
CHILDREN
The Immigration
rules do not provide for adopted children to be treated in the
same way as other children, even though British law provides
for this in nearly all other circumstances. The rule states
that adopted children will also be allowed to come to join their
adoptive parents if in addition to other requirements of the
rules (as in children under 18). Our company can assist you
in meeting the following additional requirements.
- That
an adoption "in accordance with a decision taken by a competent
administrative authority or court of his/her country of
origin or the country in which she/he is resident" has taken
place.
- That
the adoption took place either when both adoptive parents
were living together in a third country or when either or
both were settled in the UK and the child has "the same
rights and obligations as any other child of the marriage".
- That
the adoption took place because of the inability of the
birth parents or current carers to care for the child and
there has been a genuine transfer of parental responsibility.
- That
the child has lost or broken ties with the family of origin
and the adoption was not one of convenience arranged to
facilitate the child's admission for remaining in the UK.
